His resignation was announced by the East Africa Community in a Communique of the 23rd Ordinary Summit of the Heads of State.

"The summit took note of the voluntary resignation of Justice Charles Nyachae from the Republic of Kenya as a judge of the first instance division of the East African Court of Justice," the statement read.

The EAC commended him for his dedicated service to the community.

The heads of state urged Kenya to expedite the nomination of his replacement.

Nyachae was appointed by former President Uhuru Kenyatta in 2018 to serve as a judge in EACJ.
